1. Acceptance of these Terms
These Terms of Use (the "Terms") form a binding agreement between you and Danko LLC ("Danko LLC", "we", "us" or "our"), a company registered in the United States at [Danko LLC registered address], [state of incorporation]. They govern your access to and use of the Legka mobile application and related services (together, the "Service" or "Legka"). By downloading, installing, accessing or using Legka, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, do not install or use the Service.
2. The Service and your licence
Legka is a wellness and nutrition application offering features such as personal coaching guidance, food recognition and meal planning. Subject to your continued compliance with these Terms, Danko LLC grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to download and use one copy of Legka on a device you own or control, solely for your own personal, non-commercial use. This is a licence, not a sale; all rights not expressly granted to you are reserved by Danko LLC. You may not copy, modify, distribute, sell, lease, reverse-engineer, decompile or attempt to derive the source code of the Service, except to the extent this restriction is prohibited by applicable law.
3. Eligibility
You must be at least 18 years old to create an account and use Legka. By using the Service you represent and warrant that you are 18 or older and that you have the legal capacity to enter into these Terms. The Service is not directed to children, and we do not knowingly permit anyone under 18 to use it. If we learn that a user is under 18, we may suspend or terminate the account.
4. Subscriptions and billing
Some features of Legka are offered on a paid subscription basis. All paid subscriptions are sold and processed exclusively through the Apple App Store or the Google Play Store and are subject to the terms, conditions and pricing of the store through which you subscribe; the applicable price, duration and renewal terms are shown to you in the store before you confirm the purchase. Payment is charged to your App Store or Google Play account at confirmation of purchase. Subscriptions renew automatically unless you turn off auto-renewal at least 24 hours before the end of the current period. You manage, upgrade, downgrade or cancel your subscription in the settings of your App Store or Google Play account, not through Danko LLC. Refunds, where available, are handled by Apple or Google in accordance with their respective policies; Danko LLC does not process payments and cannot issue store refunds directly. There is no separate web-based payment or public offer. Apple and Google are third-party beneficiaries of these Terms as they relate to your licence to use the app, and may enforce these Terms against you.
5. Acceptable use
You agree to provide accurate, current and complete information (including profile, health and nutrition data) and to keep it up to date, since the quality of the Service depends on it. You agree not to misuse the Service, including: using it for any unlawful purpose; interfering with or disrupting its operation or security; attempting to gain unauthorised access to any systems or data; uploading malicious code; scraping or harvesting data; or infringing the intellectual property, privacy or other rights of any person. You are responsible for all activity that occurs under your account and for keeping your login credentials secure.
6. Medical disclaimer
Legka is provided for general information and wellness purposes only and is NOT medical advice. It is not a medical device and does not diagnose, treat, cure or prevent any disease or health condition. Content, recommendations, calorie and nutrition estimates, and coaching suggestions are general in nature and may be inaccurate or unsuitable for you. Always consult a qualified physician or other healthcare professional before starting, changing or stopping any diet, exercise, supplement or wellness program. If you have or suspect an eating disorder, are pregnant or breastfeeding, are under 18, or have any medical condition, illness or symptom, seek the advice of an appropriate specialist and do not rely on Legka. You are solely responsible for your own health decisions and how you use the information the Service provides. If you think you may have a medical emergency, contact your local emergency services immediately.
7. Intellectual property
The Service, including the Legka application, its software, design, text, graphics, user interface, and all associated content, together with the "Legka" name, logos and trademarks, are owned by Danko LLC or its licensors and are protected by intellectual property and other laws. Except for the limited licence granted in Section 2, these Terms do not transfer any right, title or interest in the Service to you. You retain the rights to the content and data you submit; by submitting it, you grant Danko LLC a limited licence to host, process and use that content solely to operate and provide the Service to you as described in the Privacy Policy.
8. Disclaimers and limitation of liability
To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any results or estimates it produces will be accurate or meet your expectations. To the maximum extent permitted by law, Danko LLC and its officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, profits, goodwill or health outcomes, arising out of or related to your use of or inability to use the Service. To the extent liability cannot be excluded, our total aggregate liability is limited to the amount you paid, if any, for the Service in the twelve months preceding the event giving rise to the claim. Some jurisdictions do not allow certain exclusions, so some of the above may not apply to you.
9. Termination
You may stop using Legka at any time and may delete your account through the app or by contacting us. We may suspend, restrict or terminate your access to the Service, in whole or in part, at any time and without notice, if you violate these Terms, misuse the Service, or if we are required to do so by law or to protect the Service or other users. Upon termination, the licence granted to you ends and you must stop using the Service; provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability and governing law) will continue to apply. Termination does not entitle you to a refund of amounts already charged by the store.
10. Governing law
These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of [state of incorporation], United States, without regard to its conflict-of-laws rules. Subject to any mandatory rights you may have under the laws of your country of residence, you agree that the courts located in [state of incorporation], United States, will have jurisdiction over any dispute, to the extent permitted by applicable law.
11. Changes to these Terms
We may update these Terms from time to time, for example to reflect changes to the Service or for legal or regulatory reasons. When we make material changes, we will update the "last updated" date and, where appropriate, provide notice within the app. Your continued use of Legka after the updated Terms take effect constitutes your acceptance of them. If you do not agree to the changes, you must stop using the Service.
